질문 별거하는 것은 교회의 허락이 필요한지요?

답변 예, 만약 결혼 생활에 있어서 큰 문제가 있다면, 한쪽 배우자는 ‘별거심판’에 대해 요청할 수 있습니다. 혼인의 결합(불가해소성)을 깨뜨리지 않고 큰 문제(예를 들어 폭력문제)를 피하기 위해 신중한 별거를 허용합니다. 이 별거는 ‘잠자리를 따로 사용’하거나 집 밖에서‘의 별거입니다.

그러나 위 사례에 있어서 한쪽 배우자가 이혼을 요청한다거나 다른 사람과 도망간다면 죄가 되지 않는 다른 쪽 배우자는 죄 지은 쪽과 따로 살기 위해서 별거심판을 요청할 필요는 없습니다. 선택사항의 목표가 아닌 남편(아내)가 겪는 상황입니다. 자신의 십자가를 지고 가는 허락의 요구는 없습니다.

Q  “To live separately do they need the permission of the Church?”

A  “Yes. If there is a big problem in a marriage, then one spouse can ask for such a “judgement of separation”, NOT breaking the bond of marriage, put allowing a prudent separation to avoid some big trouble (e.g. husband beating his wife…): this is only a “separation of bed” and sometimes “of roof”.

However in the case above, if one party asks for a divorce and runs away with another person, the innocent party does not need to have a judgement of separation to live separately from the guilty party: it is a situation that he/she suffers, not the object of a choice. There is no need of a permission to carry one’s cross!
