Close Relatives Married

Q What if close relatives married and have consummated their marriage? Can they obtain a declaration of nullity? What if they already had children at the time they asked for such declaration of nullity?


A  If they knew and hid the fact to the priest in the ¡°investigation prior to marriage¡±, they are clearly guilty of fraud, and their marriage is clearly not valid: they were guilty of concubinage from the beginning. If they knew they were related, but did not know it was an impediment, and the priest did NOT ask them about it, then he failed to his duty and they were in a ¡°putative marriage¡±, i.e. genuinely thinking they were married, they were not guilty of subjective sin, though their marriage was not valid. Once they know they have to abstain – of course. If they are not too close relatives, e.g. if they are second cousins, they could apply for a dispensation, especially if they have children, which the bishop could give them. With that dispensation they could then ¡°convalidate their marriage¡±; the children are considered legitimate. Note that to be closely related is an impediment according to natural law (because of the greater danger of abnormal children) and there is no ignorance for such impediment.


A marriage ¡°ratum et consummatum – ratified and consummated¡± is a valid marriage (not a putative one!) that is consummated: such marriage cannot be dissolved at all, not even by Peter¡¯s keys. But marriages ¡°ratum et NON consummatum – ratified and not consummated¡± could obtain a ¡°dissolution¡± by Peter¡¯s keys, typically if one wants to enter the religious life and thus freeing the other to marry again. But that would require virginity to be proven.
